CBDT Extends ITR Filing Deadline for AY 2026-27

The CBDT has decided to extend the due date for furnishing the return of income for AY 2026-27 from 31 October 2026 to 21 November 2026 for the specified taxpayers covered by the relevant provision of Section 139(1).

Officials extended the deadline to furnish the tax audit report from 30 September 2026 to 21 October 2026.

This gives eligible taxpayers and their tax professionals an additional 21 days to complete the audit-related compliance and file the return.

CBDT Announcement on ITR Deadline Extension

The Income Tax Department announced the extension on September 28, 2026.

The Central Board of Direct Taxes (CBDT) has decided to extend the due date of furnishing of Return of Income for Assessment Year 2026-27 in the case of persons mentioned at S. No. 2 in the Table below Explanation 2 to sub-section (1) of section 139 of the Income-tax Act, 1961… pic.twitter.com/wyLzVBXSNY

Who Gets the ITR Extension for AY 2026-27?

This extension targets taxpayers falling within the category specified at Serial No. 2 of the table under Explanation 2 to Section 139(1), where the provisions of Section 92E do not apply.

Broadly, this includes taxpayers whose accounts are subject to audit under the Income-tax Act or another applicable law, as well as certain other taxpayers covered by the statutory provision.

The main categories include:

1. Companies

Companies falling within the specified audit category can benefit from the revised deadline, subject to the applicable provisions.

For example, a domestic company generally files ITR-6, unless another form is prescribed for its category. The Income Tax Department’s AY 2026-27 guidance confirms the applicable return and audit-report requirements for companies.

For EduTaxTuber readers, this can be useful alongside our planned/related guide on ITR-6 filing for companies for AY 2026-27.

2. Individuals and HUFs Subject to Tax Audit

If they meet the applicable conditions, individuals and Hindu Undivided Families (HUFs) carrying on business or profession must have their accounts audited under Section 44AB.

Such taxpayers generally file ITR-3 when they have income from profits and gains of business or profession.

The Income Tax Department’s AY 2026-27 guidance identifies the relevant audit-report requirements for individuals having business or professional income.

3. Partnership Firms and LLPs

Partnership firms and LLPs that fall within the applicable audit provisions may also be covered.

For such taxpayers, ITR-5 is generally relevant. The Income Tax Department’s guidance for partnership firms and LLPs also refers to Form 3CB-3CD for taxpayers whose accounts are required to be audited under Section 44AB.

4. Partners of Audited Firms

The relevant category can also cover partners of firms whose accounts are required to be audited, including a spouse of such a partner where the applicable provisions of Section 5A apply.

Therefore, taxpayers should not determine eligibility solely by looking at whether they personally have a business audit. The statutory category under Section 139(1) needs to be considered.

Who Is Not Covered by This CBDT Extension?

One of the most important points is that the extension does not apply to taxpayers who are required to furnish an accountant’s report under Section 92E.

Section 92E applies to taxpayers who have entered into certain international transactions or specified domestic transactions and are required to obtain an accountant’s report in Form 3CEB. The Income Tax Department’s AY 2026-27 guidance specifically identifies Form 3CEB for taxpayers covered by Section 92E.

Therefore, taxpayers should not assume that every audit case has automatically received the same deadline.

Why Section 92E Matters

Section 92E cases operate under a separate return-filing timeline. The relevant taxpayers have a different due date under Section 139(1), rather than the 31 October deadline applicable to the category addressed by this particular CBDT extension.

This distinction is particularly important for businesses involved in international transactions, specified domestic transactions or transfer-pricing compliance.

What Are the New Tax Audit and ITR Due Dates?

For taxpayers covered by the CBDT’s September 28, 2026 announcement, the revised dates are:

Tax Audit Report:
30 September 2026 → 21 October 2026

Income Tax Return:
31 October 2026 → 21 November 2026

The extension therefore provides 21 additional days for both stages of the compliance process.

The Income Tax Department’s existing guidance states that tax audit reports under Section 44AB are to be furnished before the corresponding ITR due date.

Which Tax Audit Forms Apply?

For AY 2026-27, taxpayers covered under the Income-tax Act, 1961 continue to encounter the relevant audit-report forms prescribed under the existing framework.

Depending on the circumstances, the audit documentation can include:

  • Form 3CA-3CD
  • Form 3CB-3CD
  • Form 3CEB, where Section 92E applies

The Income Tax Department states that Form 3CA-3CD applies in specified cases where accounts are required to be audited under another law and the taxpayer is also subject to Section 44AB, while Form 3CB-3CD applies to taxpayers required to get their accounts audited under Section 44AB.

Form 3CEB is relevant to taxpayers required to obtain an accountant’s report under Section 92E.

Important: AY 2026-27 vs Tax Year 2026-27

Taxpayers should also be careful while reading information about the Income-tax Act, 2025 and the new Income-tax Rules, 2026.

The Income Tax Department now provides separate transition material explaining the interaction between the Income-tax Act, 1961 and the Income-tax Act, 2025.

For this particular AY 2026-27 deadline extension, the CBDT announcement specifically refers to the Income-tax Act, 1961 and Section 139(1). Therefore, readers should not automatically apply rules meant for the new tax-year framework to this AY 2026-27 compliance deadline.

What Should Taxpayers Do With the Additional Time?

The extension should not be treated as a reason to postpone compliance until the final day.

Taxpayers covered by the extension can use the additional time to complete the following steps.

1. Complete the Books of Accounts

Ensure that books of accounts are updated and reconciled with bank statements, sales records, purchase records, expense records and other supporting documents.

2. Complete the Tax Audit

Taxpayers should coordinate with their Chartered Accountant and provide all required financial and supporting information for completion of the audit.

3. Check the Audit Report

Once the audit report is prepared, taxpayers should verify the information before proceeding with the ITR.

Particular attention should be given to turnover, expenses, depreciation, deductions, tax payments and other figures that flow into the income-tax return.

4. Reconcile AIS and Form 26AS

Taxpayers should also compare relevant income and tax information with Annual Information Statement (AIS) and Form 26AS.

Any mismatch should be investigated and corrected wherever required before filing the return.

Suggested internal link:
AIS vs Form 26AS: Difference, How to Check and What Taxpayers Should Do

5. Select the Correct ITR Form

The correct return form depends on the taxpayer’s status and nature of income.

For example:

  • ITR-3 – generally relevant to individuals and HUFs having business or professional income.
  • ITR-5 – generally used by firms, LLPs and certain other specified persons.
  • ITR-6 – generally used by companies other than companies claiming exemption under Section 11.

The Income Tax Department provides taxpayer-specific guidance for these forms for AY 2026-27.

6. File and Verify the ITR

After the audit-related information has been finalised and the return has been prepared, taxpayers should file the ITR by the applicable revised due date.

Taxpayers should also complete the required verification of the return.

Does the Extension Mean Every Taxpayer Gets Time Until 21 November?

No.

This is one of the most important points to understand.

The CBDT announcement does not extend the ITR deadline for every taxpayer. It specifically covers the persons falling within the relevant category under Explanation 2 to Section 139(1).

Therefore, taxpayers whose original ITR due date was different should not automatically assume that their deadline has now become 21 November 2026.

Similarly, taxpayers covered by Section 92E should consider their separate statutory deadline.

Is the Extension for the Tax Audit Report Also 21 Days?

Yes. For the specified taxpayers covered by the announcement, the tax audit report deadline moves from 30 September 2026 to 21 October 2026.

The corresponding ITR deadline moves from 31 October 2026 to 21 November 2026.

This provides taxpayers and tax professionals additional time between the completion of the audit report and the filing of the return.

Why Taxpayers Should Not Wait Until the Last Date

Although an extension provides additional compliance time, taxpayers should ideally complete their filings well before the revised deadline.

Last-minute filing can create problems such as:

  • Errors in income or expense reporting
  • Mismatch between books and ITR
  • Incorrect selection of ITR form
  • AIS or Form 26AS discrepancies
  • Missing audit-report details
  • Portal-related issues
  • Delays in verification
  • Difficulty obtaining clarification from the auditor

The Income Tax Department has been issuing reminders to taxpayers regarding audit reports and AY 2026-27 return filing.

CBDT ITR Deadline Extension: What Taxpayers Should Remember

The key point is that the 21 November 2026 deadline is not a universal ITR extension.

It applies to the specific category of taxpayers covered by the CBDT announcement under the relevant provisions of Section 139(1), while Section 92E cases remain distinct.

For eligible taxpayers, the revised compliance calendar is:

Tax Audit Report: 21 October 2026
ITR Filing: 21 November 2026

Taxpayers should use the additional time to complete their audit, verify the audit report, reconcile their financial information and file the correct ITR.

Taxpayers should check the Income Tax Department’s guidance and the statutes before filing, especially for international or other specialised reporting.
